Welcome to SEOAnalyst.in, India’s dedicated SEO community hub. These Terms & Conditions (the “Terms”, “Terms of Use”, or “User Agreement”) govern your access to and use of the website, mobile interfaces, and related services offered by SEOAnalyst.in (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

We operate as an online community and listing Platform that allows:

  • SEO professionals to create public profiles;
  • SEO agencies/businesses to create listings;
  • Users to list and promote SEO-related events;
  • Users to post and apply for SEO jobs;
  • Recruiters/hiring managers to find and connect with SEO talent; and
  • Members to share content, interact, and network.

These Terms are written in plain language but are legally enforceable. They include our user-generated content policy, rules for listings and community participation, and statements about Indian IT Act compliance and data protection under DPDP 2023.

1) Introduction & Acceptance

1.1. By visiting, registering for, or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

1.2. We may update these Terms at any time. Material changes will be highlighted on the Platform or communicated by email (if available). Your continued use after the effective date of updated Terms constitutes consent to the revised Terms.

1.3. Supplemental terms or policies (for example, community guidelines or event/job posting rules) may apply to certain features. If there is a conflict, the supplemental terms control for that feature.

2) Eligibility

2.1. You must be at least 18 years old and legally capable of entering into a binding contract under Indian law.

2.2. You agree to use the Platform in compliance with all applicable Indian laws, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended) (“IT Rules 2021”), the Digital Personal Data Protection Act, 2023 (“DPDP 2023”) and the Indian Copyright Act, 1957, among others.

3) Account Registration & Security

3.1. When you create an account or profile, you agree to provide accurate, current, and complete information, and to keep it updated.

3.2. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.3. You agree to notify us immediately of any unauthorized use or suspected breach of security. We may require additional verification or suspend access to protect users and the Platform.

3.4. You must not create accounts by automated means, impersonate others, or misrepresent your identity, qualifications, or affiliations.

4) User-Generated Content (UGC)

4.1. The Platform hosts content provided by users (profiles, posts, comments, messages, listings, job posts, event posts, portfolios, images, logos, and other materials). You retain ownership of your content.

4.2. License to SEOAnalyst.in: By submitting or posting content, you grant SEOAnalyst.in a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content for operating, improving, and promoting the Platform, including in search results, emails, social media, and marketing materials. This license ends when you remove your content from the Platform, except to the extent your content has been shared by others, incorporated into aggregated materials, used for security/compliance logs, or backed up in systems that will be purged in the ordinary course.

4.3. Your responsibilities: You represent and warrant that you have the necessary rights to the content you post; that it is truthful, lawful, and not misleading; and that posting it does not infringe any third-party rights (including copyright, trademark, privacy, and publicity rights).

4.4. No prohibited content: You must not post or share content that is illegal, defamatory, obscene, hateful, harassing, invasive of privacy, sexually explicit, exploitative, threatening, harmful (including malware), or otherwise unlawful under Indian law. Plagiarism, deceptive claims, fake endorsements, and misrepresentation of skills, experience, or company information are prohibited.

4.5. Moderation rights: We may (but are not obligated to) review, moderate, refuse, remove, or restrict any content or access to the Platform at our discretion, including when content violates these Terms or applicable law. We may also edit listings to improve consistency, remove prohibited claims, or correct categorization.

4.6. Reporting & takedown: If you believe content is unlawful or infringes your rights, please use our notice mechanism under Section 11 (Indemnification & Notices) and Section 13 (Termination) below. We will handle complaints in line with Section 79 IT Act safe-harbour obligations and the IT Rules 2021.

5) Business & Event Listings

5.1. Relevance & accuracy: Business and event listings must be truthful, verifiable, and directly relevant to SEO or related services (analytics, content marketing, link building, performance marketing, site audits, technical SEO, conferences, workshops, webinars).

5.2. No spam or abuse: Repetitive or irrelevant promotions, keyword stuffing, undisclosed affiliate links, or spam are prohibited.

5.3. Claims & endorsements: Substantive claims (for example, “#1 agency in India”) must be verifiable with objective evidence. Paid promotions must be clearly disclosed.

5.4. Events compliance: Event organizers are solely responsible for permits, venue safety, tickets, taxes, and compliance with applicable laws.

6) Job Postings & Hiring

6.1. Job postings must comply with Indian labour and employment laws, equal opportunity standards, and applicable state notifications.

6.2. No discriminatory, misleading, fake, or bait-and-switch postings. Accurately disclose role type, location/remote, compensation range (if stated), required skills, and hiring entity.

6.3. The Platform is not an employer and does not guarantee outcomes (interviews, offers, or placements). Any communication, assessment, background verification, contract, or payment occurs directly between the parties.

6.4. Recruiters and hiring managers must use applicant data only for recruitment purposes and handle personal data per DPDP 2023 and our Privacy Policy.

8) Intellectual Property

8.1. Except for user content, the Platform and all materials on it—including text, code, design, compilation, trademarks, logos, and graphics—are owned by or licensed to SEOAnalyst.in and are protected by copyright, trademark, and other intellectual property laws.

8.2. You may access and use the Platform for personal and business purposes related to SEO networking, hiring, events, and listings. Any unauthorized reproduction, distribution, modification, public display, or creation of derivative works is prohibited.

8.3. You may not use our trademarks, logos, or brand elements without prior written permission.

9) Privacy & Data Protection

9.1. Our Privacy Policy explains how we collect, use, store, and share personal data. By using the Platform, you consent to our data practices as described there.

9.2. We process personal data in line with DPDP 2023 and rules as notified, applying principles of lawful purpose, consent or valid grounds, data minimization, security safeguards, retention limits, and Data Principal rights (such as access, correction, and erasure).

9.3. Recruiters and businesses must handle applicant and attendee data responsibly, use it only for the stated purpose, and implement reasonable security.

9.4. Where permitted, we may process data to prevent fraud, ensure network and information security, and comply with legal obligations.

10) Disclaimers & Limitation of Liability

10.1. The Platform is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10.2. We do not guarantee the accuracy, completeness, timeliness, or reliability of user content, listings, reviews, rankings, or job outcomes. You rely on information at your own risk and should conduct independent verification.

10.3. As an intermediary under Section 2(1)(w) and safe-harbour under Section 79 of the IT Act, we do not initiate the transmission or select the receiver or modify user content and are not liable for third-party content, subject to compliance with due diligence under the IT Rules 2021.

10.4. To the maximum extent permitted by Indian law, SEOAnalyst.in will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Platform—even if advised of the possibility of such damages.

10.5. In any event, our aggregate liability for all claims relating to the Platform shall not exceed the greater of INR 10,000 or the total fees (if any) paid by you to SEOAnalyst.in for paid services in the three (3) months preceding the claim.

11) Indemnification & Notices

11.1. You agree to indemnify, defend, and hold harmless SEOAnalyst.in, its affiliates, officers, directors, employees, and agents from and against any claims, demands, actions, liabilities, losses, damages, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your content, listings, events, or job postings; (c) your violation of these Terms or applicable law; or (d) your infringement or misappropriation of any third-party rights.

11.2. IP or legal notices: To report infringement, unlawful content, or other legal issues, please submit a detailed notice including your contact information, description of the content, location URL(s), the legal basis for your complaint, and any supporting documents. We may share your notice with the affected user.

11.3. We may, in good faith and upon receiving actual knowledge via a court order or appropriate government notice, remove or disable access to impugned content in accordance with the IT Rules 2021.

12) Third-Party Links & Services

12.1. The Platform may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy practices, or availability of those sites.

12.2. Your dealings with third parties (including payment gateways, webinar platforms, or ATS tools) are solely between you and the third party.

13) Termination of Access

13.1. We may suspend or terminate your account, remove content, or restrict access at any time if we believe you violated these Terms or applicable law, caused risk or possible legal exposure, or upon user/rights-holder complaints.

13.2. You may deactivate your account at any time through your settings. Certain data may persist for legal, security, or backup purposes.

13.3. Upon termination, your right to use the Platform immediately ceases. Sections that by their nature should survive (including Sections 4–11 and 14–17) will survive termination.

14) Governing Law & Dispute Resolution

14.1. These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of laws principles.

14.2. Arbitration (prior to litigation): Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai, Tamil Nadu, conducted by a sole arbitrator mutually appointed by the parties; if the parties cannot agree, the appointment shall be made in accordance with applicable law. The language of arbitration shall be English. Each party bears its own costs; the arbitrator may allocate costs in the award.

14.3. Subject to the arbitration clause above, the courts located in Chennai, Tamil Nadu shall have exclusive jurisdiction over all disputes. Nothing prevents a party from seeking injunctive or equitable relief for protection of intellectual property or confidential information.

15.3. We will acknowledge complaints within 24 hours and dispose of them within 15 days, or as otherwise required under applicable law.

16) Additional Platform Rules

16.1. Reviews & endorsements: Reviews must be based on real experiences. Undisclosed paid reviews or incentives must not be used to manipulate ratings.

16.2. Advertising & promotions: We may display advertising or sponsored content. Where we promote user listings (e.g., “featured”), that is not an endorsement or guarantee.

16.3. Search & ranking: Visibility of profiles and listings may vary due to activity, completeness, relevance, recency, quality signals, and trust/safety considerations. We may update ranking signals periodically.

16.4. Feedback: If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use it without any obligation to you.

16.5. Security & disclosure: If you discover a vulnerability, report it responsibly via legal@SEOAnalyst.in. Do not exploit or publicly disclose before we remediate.

17) Intermediary Status & Compliance Statement

17.1. SEOAnalyst.in is an intermediary under the IT Act, 2000, hosting third-party information and providing access to a communication system over which information is made available by users.

17.2. We comply with due diligence requirements under the IT Rules 2021 (as amended), including publication of these Terms and our Privacy Policy, a user-generated content policy, and a grievance redressal mechanism.

17.3. Where applicable, we will act on lawful orders or government notices and will cooperate with lawful requests from competent authorities, consistent with Indian law and user privacy protections.

17.4. Users are responsible for ensuring their content and activities are lawful and for promptly complying with any notices or requests conveyed through the Platform.

18) Miscellaneous

18.1. Entire Agreement: These Terms, along with any supplemental terms and the Privacy Policy, constitute the entire agreement between you and SEOAnalyst.in with respect to the Platform.

18.2. Severability: If any provision is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3. No Waiver: Our failure to enforce any provision shall not be deemed a waiver of our rights.

18.4. Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, or sale of assets.

18.5. Electronic Communication: You consent to receive communications electronically and agree that all terms, notices, and disclosures delivered electronically satisfy legal requirements.
